theNeedle SMS Messaging Terms
theNeedle — Terms that apply when a user voluntarily enrolls in SMS messaging from theNeedle, including consent, frequency, opt-out, and carrier disclosures.
Overview
These theNeedle SMS Messaging Terms apply when a user voluntarily enrolls in SMS messaging from theNeedle, a product operated by Crescentic LLC ("Crescentic," "we," "our," or "us").
These SMS Messaging Terms supplement the theNeedle Terms of Service and the theNeedle Privacy Notice.
01Program name and operator
Program name: theNeedle SMS Notifications
Operator: Crescentic LLC
02Types of messages
theNeedle may send recurring, non-marketing SMS messages concerning:
- Account-security verification
- User-enabled priority email alerts
- Sent-message follow-up reminders
- Connected-email account issues
- Service and account notifications
- Other transactional notifications expressly enabled by the user
The theNeedle SMS program does not include promotional marketing unless the user separately provides the consent required for a separate marketing program.
03Enrollment and consent
Enrollment in theNeedle SMS messaging is optional.
A user may enroll by:
- Entering a mobile telephone number in theNeedle
- Reviewing the SMS consent disclosure
- Affirmatively selecting an unchecked SMS consent checkbox
- Selecting the control that enables SMS notifications
- Completing telephone-number verification where required
SMS consent is separate from acceptance of theNeedle Terms of Service and is not a condition of purchasing, subscribing to, or using theNeedle.
After enrollment, the user will receive an SMS confirmation identifying theNeedle and explaining message frequency, rates, HELP, and STOP options.
04Message frequency
Message frequency varies based on user notification settings, connected-inbox activity, account-security events, email-account connection status, and service activity.
Crescentic does not guarantee a minimum or maximum number of messages.
05Charges
Message and data rates may apply.
The user's mobile carrier determines applicable message, data, roaming, and other charges. Crescentic is not responsible for carrier charges.
06Opting out
Users may opt out at any time by replying:
- STOP
- UNSUBSCRIBE
- CANCEL
- END
- QUIT
After an opt-out request, the user will receive a confirmation message and no further messages will be sent through the theNeedle SMS program unless the user enrolls again.
Opting out of SMS does not delete the theNeedle account, cancel a paid subscription, disconnect an email account, disable email, in-app, push, security, legal, or other communications, or prevent communications independently required by law.
07Help
Users may reply:
- HELP
- INFO
- SUPPORT
For assistance, contact support@crescentic.ai. A HELP response may include the theNeedle program name, support information, message-frequency disclosure, rate disclosure, and STOP instructions.
08Re-enrollment
A user who previously opted out may enroll again through the SMS controls made available in theNeedle.
Crescentic may require the user to repeat the consent and verification process.
09Telephone-number ownership
Users must provide a mobile telephone number that they are authorized to use. A user must promptly update or remove the number if:
- The number is changed
- The number is disconnected
- The number is reassigned
- The user no longer controls the number
- The user is no longer authorized to receive messages at the number
Crescentic may suspend SMS messaging where it reasonably believes that a number is invalid, reassigned, unauthorized, or associated with misuse.
10Delivery and carrier limitations
SMS delivery depends on mobile carriers, telecommunications networks, device settings, service availability, and other factors outside Crescentic's control.
Messages may be delayed, blocked, duplicated, misdirected, or undelivered.
Carriers are not liable for delayed or undelivered messages.
Crescentic does not guarantee that an SMS alert will be delivered before action is required. Users remain responsible for directly reviewing their email accounts and theNeedle application.
11Supported carriers and devices
SMS availability may vary by carrier, telephone number, device, location, and service plan.
Crescentic may change messaging providers or limit SMS availability where reasonably necessary.
SMS may not be available in every country or territory.
12Privacy and mobile-information protection
Crescentic's handling of mobile information is described in the theNeedle Privacy Notice.
Crescentic may provide mobile information to telecommunications carriers, messaging providers, and other service providers solely to verify, operate, deliver, secure, and support the theNeedle SMS program. Those providers may use the information only to perform services for Crescentic and may not use it for their own marketing or promotional purposes.
